Amendments to Dwell Time and Free Time Regulations for Loading and Unloading

The Infrastructure Decree (Law Decree No. 73 of May 2025), recently enacted, introduces several key changes to the regulation of dwell time and free time during loading and unloading operations.

Here are some of the most significant updates:

  • Dwell Time and Application of Free Time

    Under the new Decree, the free time allowance now also covers the actual time spent on loading and unloading operations.

The allowable waiting time without incurring demurrage charges (free allowance) has been shortened from 2 hours to 90 minutes.

Shippers and/or consignors, as well as consignees, must provide the carrier with clear instructions regarding the location and scheduled time for loading/unloading operations, along with accurate access information.

The Decree now permits carriers to certify their arrival time at the loading point, which triggers the free time period, via vehicle GPS systems or second-generation smart tachographs.

  • Compensation for Waiting Times Exceeding 90 Minutes

    The compensation has been set by law at €100 for each hour-or fraction thereof- of waiting time beyond the 90-minute allowance.

This compensation is jointly and severally applicable to both the shipper and the consignor, except in cases where the delay is attributable to the carrier.
